The Board of Public Utilities (BPU) Order approving the sale of Trenton's Outside Water Utility System (OWUS) to NJ American Water actually takes into consideration that possibility of an appeal of the court ruling that invalidated the petition to stop the sale. At the bottom of page seven of the document, and continuing over to page eight, is the following paragraph: "The order shall be effective upon issuance. However, it shall be automatically stayed if a timely appeal is taken to a court of competent jurisdiction pursuant to Rule 2:4-1 of the New Jersey Court Rule, from the order of Mercer County Superior Court Law Division, in In Re Petition for Referendum on City of Trenton Ordinance 09-02, Docket MER-L-548-09, issued on March 16, 2009. In the event of a timely appeal, the stay shall remain in effect until the appeal is resolved. If no timely appeal is filed, this Order shall remain in full force and effect."
